📜 Terms & Conditions

0. Scope of These Terms

These Terms & Conditions apply to all services offered by Infame Films JP, including but not limited to: guided tours, photo tours, elopements, engagement sessions, events, and travel short films. Where a specific clause applies only to certain services (e.g., large productions or short films), it is labeled clearly.

1. Bookings & Payments

To secure your date, you may choose one of the following:

  • Pay a 50% deposit to reserve your session, with the remaining 50% due before your session (see Section 2), or

  • Pay 100% upfront at the time of booking.

The 50% deposit is non-refundable. This applies regardless of the payment option chosen — even if you later pay the remaining balance, the first 50% you paid remains non-refundable under the terms of Section 3.

Accepted payment methods:

  • Bank transfer — available for clients paying from within Japan only.

  • PayPal and Wise — available worldwide.

  • Credit card — via Stripe, available worldwide.

Current pricing is listed on our booking/pricing page at the time of your inquiry. Prices confirmed in your booking invoice are the prices that apply to your session, regardless of later published rate changes.

2. Payment Completion & Delivery

  • Full payment is required before your session date (or by the deadline stated in your booking confirmation).

  • If the remaining balance is not paid in full, Infame Films JP will not deliver any material — this includes final edited files, previews, proofs, or watermark-free samples of any kind.

  • This policy exists to protect both sides from misunderstandings: it means we never have to chase unpaid balances after delivering your gallery, and you always know exactly what "fully booked" means before your day arrives.

  • Sessions with an outstanding balance may be rescheduled or cancelled at Infame Films JP's discretion if payment is not resolved within a reasonable window communicated in writing.

2.1 Large Productions & Short Films — Non-Attendance Policy

For short films, commercial work, and other large productions (as opposed to standard elopement/portrait sessions), full payment must be settled by the day of the event.

  • If the balance remains unpaid by the event date, Infame Films JP reserves the right not to attend the shoot.

  • We will notify you in writing at least 48 hours before the event if a balance remains outstanding, giving you a clear final window to settle it before this clause applies.

  • Any deposit already paid remains non-refundable under Section 3, regardless of attendance.

This clause exists because large productions involve significant upfront investment on our side (crew time, equipment, travel, blocked availability) that standard sessions do not — we want to be direct about this rather than leave it ambiguous.

3. Cancellations & Refunds

As a general rule, all payments made to Infame Films JP are non-refundable. Your booking reserves your date exclusively — once confirmed, we turn away other clients for that day and begin pre-production (scouting, permits, planning) on your behalf.

The only exceptions to this rule are:

  1. Death of the titular client (the person who booked the session), or

  2. Natural disasters that make the session impossible to hold (e.g., typhoon, earthquake, or official government travel restriction issued for safety reasons).

In either of these cases:

  • We will always offer to reschedule your session at no additional cost, valid for up to 12 months from the original date.

  • If rescheduling is genuinely not possible, Infame Films JP will refund 50% of the total amount paid. The remaining 50% is retained to cover pre-production work, date exclusivity, and costs already incurred.

For all other circumstances (illness, accidents, missed flights, personal emergencies, visa issues, or any other reason a client cannot attend), no cash refund will be issued — but Infame Films JP will make reasonable efforts to offer a free rescheduling to a new date, subject to availability, when requested with reasonable notice. This is a courtesy, not a guaranteed right, and may not be possible during high-demand seasons (cherry blossom season, autumn foliage, major holidays).

All dates and deadlines are calculated based on Japan Standard Time (JST).

3.1 Client Conduct & Safety

Infame Films JP reserves the right to suspend or terminate a session or tour at any time, without refund, if a client or member of their party appears to be under the influence of drugs or alcohol to a degree that disrupts the session, engages in illegal activity, or harasses, threatens, or behaves abusively toward our staff. In such cases, we reserve the right to stop work immediately and, if necessary, contact local authorities. Any deposit or payment already made remains non-refundable under Section 3.

4. Rescheduling

  • Rescheduling due to weather, natural disaster, or the emergencies described in Section 3 will incur no extra fees.

  • Rescheduling requested for other reasons (change of plans, travel changes, etc.) will be accommodated when possible but is not guaranteed, and may be subject to availability and seasonal demand.

  • For larger productions (commercial, corporate, multi-day shoots), rescheduling terms will be outlined individually in your project contract.

  • Rescheduled sessions remain subject to all terms in this document, including the non-refundable nature of any deposit already paid.

5. If Infame Films JP Must Cancel

  • If Infame Films JP must cancel your session due to illness, accident, or extreme circumstances on our end, you will receive a full refund of all amounts paid, or the option to reschedule at no cost — your choice. If possible we will help you find another photographer or guide for the same fare you paid.

  • We will always communicate a cancellation on our part as early as possible.

6. Copyright and Usage Rights

  • Infame Films JP retains copyright for all work produced. We will not use any material without your approval (see Privacy Policy).

  • Clients receive personal usage rights (social media, printing, sharing).

  • Commercial usage requires a separate license or buyout agreement.

  • Full copyright transfer may be arranged for an additional fee.

7. RAW Files

  • By default, only edited files are delivered.

  • RAW Photos: May be purchased for 30% of the booking’s total commercial value (minimum ¥6,600), unless already included in your contracted package.

  • RAW Video: May be purchased for 30% of the project’s total commercial value.

  • RAW files are delivered as-is and do not reflect Infame Films' final creative vision.
